For the purposes of these terms and conditions, the following definitions apply:
Hak Tours: the coach company located in [place of business], registered with the Chamber of Commerce under number [Chamber of Commerce number].
Client: the natural or legal person who enters into an agreement with Hak Tours.
Passenger: any natural person who uses the transportation services under the agreement.
Agreement: the transportation agreement between Hak Tours and the client.
2.1 These general terms and conditions apply to all offers, quotations, services, and agreements between Hak Tours and its clients.
2.2 Deviations from these terms and conditions are valid only if agreed upon in writing.
3.1 All quotes from Hak Tours are non-binding, unless otherwise stated in writing.
3.2 An agreement is concluded as soon as the client agrees to the quote in writing or verbally or confirms the booking.
3.3 Hak Tours reserves the right to refuse orders without providing reasons.
4.1 Payment must be made within 14 days of the invoice date, unless otherwise agreed.
4.2 In the event of late payment, the client is automatically in default and is liable for statutory interest.
4.3 All judicial and extrajudicial collection costs shall be borne by the client.
5.1 Cancellation must be made in writing.
5.2 In the event of cancellation, the client shall owe the following fees:
up to 30 days before departure: 10% of the total amount;
29 through 14 days before departure: 25% of the total amount;
13 through 7 days before departure: 50% of the total amount;
6 through 2 days before departure: 75% of the total amount;
6.1 Hak Tours is not liable for damages resulting from delays, mechanical breakdowns, heavy traffic, weather conditions, or other force majeure events.
6.2 Hak Tours is liable only for direct damages caused by willful misconduct or gross negligence.
6.3 Hak Tours is not liable for the loss, theft, or damage of passengers’ personal belongings.
7.1 The client must ensure that accurate information is provided regarding the destination, times, and number of passengers.
7.2 Passengers must follow the driver’s instructions and behave in an orderly manner.
7.3 Smoking, alcohol, and drugs are prohibited on the tour bus.
8.1 In the event of force majeure, Hak Tours is entitled to terminate or postpone the agreement in whole or in part without being obligated to pay any compensation.
9.1 Complaints must be submitted in writing to Hak Tours no later than 7 days after the service has been provided.
10.1 All agreements are governed by Dutch law.
10.2 Disputes shall be submitted to the competent court in [city], unless otherwise provided by law.
